姚华康找到冯东野，提出想要投奔他，一番讨价还价后搭成口头协议，可还没等他来得及行动，就被小林武义抓捕。警察队长郝有才来找冯东野，求他前去救人，并告诉他，城里日本兵只有不到四十人的非整编小队，到时候几百名伪警察全都听从冯东野指挥，而且奉上日军军火库。冯东野与张恒、陈汉生商量，觉得这是个机会，决定大干一场，一举光复城市，在浙东树立忠义救国军的大旗。一切依计而行，等冯东野、陈汉生、张恒率部进入城门，却发现被小林武义包围。原来这不过是小林武义的计谋而已。冯东野、陈汉生和张恒不战而降，被编为汪伪和平建国军新编第十军，成为可耻的伪军。姚华康被小林武义枪毙。
